Japan Travel KK (hereafter, JapanTravel), owner and operator of www.japantravel.com, created the following Terms of Use to protect JapanTravel, JapanTravel contributors and publishers, (hereafter Members) and JapanTravel content.

  1. Perpetual, Unrestricted License

    JapanTravel agrees that Content will remain the sole and exclusive property of Member. All content used off-site will typically either link to Member article and/or acknowledge the Member by name.

    Member grants a perpetual, non-cancellable license to JapanTravel to use, copy, translate, modify, display, publish or otherwise exploit text, images, photos, video or other Member created materials (hereinafter "Content") in whole or part in any medium without limitation on a non-exclusive basis.

    JapanTravel uses content provided by Members in order to support the ongoing maintenance costs of JapanTravel. Content may be also bartered in exchange for products and services in our rewards store.

    Member agrees to not assert any claim against future revenues, business, shares, privileges, or other advantages gained through such reproduction and Content use.

    Member warrants that it is the sole and rightful owner, or rightful representative of such owner or owners, of Content and has the full rights and permissions to execute this Agreement, and will indemnify JapanTravel if an ownership or rights claim is made by a third party.

  2. Compensation

    Member agrees that Website exposure, crediting of Content, and any additional incentives or compensation mutually agreed upon, constitute full and fair compensation for providing the Rights herein to JapanTravel.

  3. Usage of Content

    Member agrees that reproduction and use of Content may include but not be limited to: reproduction on Website, distribution through online and print affiliates and syndicators, reproduction on physical goods, PR and promotions, editing or manipulating of Content to create new works, and sale in digital format of copies of those original and new works.

    JapanTravel agrees that Member retains its rights to enter into separate reproduction and use agreements with other parties besides JapanTravel and its related parties.

  4. Attribution / Photo Policy

    JapanTravel encourages other website operators and distributors of electronic text to include links to original JapanTravel articles and websites. For persistent links, we request the courtesy of a notice prior to doing so. When crediting specific articles, please use the following format:

  5. Commercial Use

    JapanTravel makes no warranty to the accuracy of the content of this site, or the safety of the content. Visitors must take personal responsibility for use of this site.

  9. Site Management

    JapanTravel may change, update, or delete content from this site at any time. JapanTravel may also interrupt or discontinue operation of this site whenever it is deemed necessary. JapanTravel is not responsible for correcting content on this site to ensure its accuracy.

    Since we are specifically a website about travel to Japan and have historically committed not to take any stance over non-travel events and issues, we ask for your cooperation in respecting our desire for neutrality and to post your political views on other more appropriate fora.

    If you feel the need to comment about politically sensitive issues, please do not post those views here as they are not relevant for a travel site. Neutrality does not mean we support ignorance, and we encourage you to visit other Japan-specific sites that do accept open-topic reader comments.

  10. Non-liability Statement

    In no event shall JapanTravel be liable for any of the damages listed below or any other damage that might be caused by the use of this site.

    (1) Any damage that might be caused by information contained on the site, as well as any damage caused by the changing or deletion of that information, or any damage caused by the interruption or discontinuation of the operation of the site.

    (2) Any damage caused by data, information, views, opinions, and recommendations by JapanTravel staff, contributors or other individuals or companies provided in any JapanTravel media channel.

  11. Commercial and Trademark Protection

    Product, service, or corporate names mentioned in the content may be protected by trademark or similar intellectual property laws of Japan. Any mention of such marks by JapanTravel.com in no way implies that they are not protected under applicable law, nor is it implied that there is any commercial relationship between Japan Travel K.K. and that trademark holder.

  13. Governing Law

    This Agreement, and all transactions contemplated hereby, shall be governed by, construed and enforced in accordance with the laws of Japan, without regard to the principles of conflict of laws.

    JapanTravel.com, is produced by Japan Travel KK, and references to JapanTravel, JT, JapanTravel.com or Japan Travel KK shall in general be interchangeable.

How we protect your personal information

Privacy Policy

Japan Travel KK (hereafter, JapanTravel), owner and operator of www.japantravel.com, handles and works to protect the personal information of customers and users as follows.

Introduction

This policy covers how JapanTravel treats personal information that it collects and receives, including information related to your past, present and future use of JapanTravel, and its services. Personal information means information about you which personally identifies you, like your name, address, email address, or phone number, and other data which is not otherwise publicly available.

Information Collection, Use, Sharing and Disclosure

  1. Customer Personal Information Kept by JapanTravel

    JapanTravel keeps a portion of personal information provided by customers in travel requests and other transactions as personal data. JapanTravel also handles personal data entrusted to it by other travel companies in order to provide travel arrangements requested by those companies.

  2. Reasons for Use of Customer Personal Information

    JapanTravel and Partners may use personal information provided in travel forms, surveys and site registration to contact customers for travel services, including the arrangement of transportation and accommodations.

  3. Sensitive Information

    JapanTravel does not collect, use or provide information to third parties on political opinions, faith (religion, philosophy, or creed), race or ethnicity, medical treatment, sexual history or criminal history except where permitted by law. Also, when sensitive information is collected, used, or provided to a third party, JapanTravel takes special care in its handling so as not to collect, use, or provide information in a way that is not in accordance with the law.

  4. Providing Customer Personal Information to Third Parties

    Unless stated otherwise, JapanTravel does not rent, sell or share personal information with third parties or non-affiliated companies except to provide products or services under the following circumstances:

    • JapanTravel will provide in electronic form a customer’s name, gender, age, address, phone number, e-mail address, passport number, and credit card number to transportation, accommodation, insurance and travel companies as necessary to arrange purchased travel services, or as necessary to fulfill travel agreements or complete insurance formalities to securitize costs when accidents occur.
    • Where required by law or other legal proceedings to divulge such information to the authorities or where there is suspected fraud or potential threats to the physical safety of any person.
  5. Collection and Use of Customer Personal Information

    JapanTravel handles the collection and use of customer personal information as follows:

    • Customers are presented with a clearly worded policy on the purpose of collection and types of use in pamphlets and travel request forms, web site and permission for use and collection is sought.
    • When the information is provided to data storage companies or third parties, customers will be notified, and permission will be sought.
    • Though customers are free to choose whether or not to provide any or all types of personal information when requesting travel services or information, there are instances where JapanTravel will not be able to contact the customer or complete procedures necessary to provide the requested services when some or all information is not provided, and thus will not be able to accept the requests for services from the customer.
  6. Inquiries, Release, Deletion, and Correction of Customer Personal Information

    Anyone who requests that we disclose, delete or destroy, change, stop the use, or stop sharing with third parties their individual customer personal information in our possession will be provided with the necessary steps to do so by contacting the departments listed below. When requested, we will take all necessary measures as set by laws and company regulations without delay.

    If we are unable to comply with all or part of your request, we will provide an explanation.

  7. In Circumstances When Personal Information is Leaked

    If for some reason JapanTravel personal information is disclosed, we will do our best to contact the customer immediately. If necessary, we will temporarily shut down our system to maintain security, or we may promptly announce facts about the situation publicly on our website and newsletter.

  8. Court of Jurisdiction

    The laws of Japan shall be applied to this website and terms of use and visitors consent to the jurisdiction of the Tokyo District Court in any and all disputes.

Changes to this Privacy Policy

JapanTravel may update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your JapanTravel account or by placing a prominent notice on our site. JapanTravel.com, is produced by Japan Travel KK, and references to JapanTravel, JT, JapanTravel.com or Japan Travel KK shall in general be interchangeable.

Travel Agency – Terms and Conditions

Japan Travel KK is both a travel agency and an online reseller (“Webshop”) of other vendor’s products and services. Our travel agency (“TA”) Type 2 licence in Japan is 2-7033, and we are bound by the rules and regulations of Japan, which can be found here.

Depending on whether you are a TA customer or a Webshop customer, our agreements with you differ. This agreement covers our TA service, and provides our terms and conditions that apply over and above the basic travel agency laws. By purchasing a product or service from us as a travel agent, you agree to these and the related terms and conditions set out below.

Tours

We define Tours as a group of travel and related services that extend for more than one day. While this document contains our general terms and conditions, as tours are complex to organize and deliver, each tour may have its own specific terms and conditions, and if so, they will either supersede or be additional to, as stated therein, the terms and conditions set out herein. After reviewing your specific tour documentation, if you have additional questions about the overall terms and conditions, please contact our Travel Agency Help Desk.

  1. Deposit and Final Payment

    To purchase an In-house Tour, we require two stages of payment: i) a deposit of 25% of the tour price or JPY100,000 per person, whichever is higher, ii) a final payment of the remaining price due no later than 61 days prior to the Date of Departure. Cancellation fees are set out below.

  2. Payment Methods

    Payment must be in Japanese Yen, and can be made by credit card (Visa, Master Card, American Express, Diners, or Union Pay), bank-to-bank telegraphic transfer, or PayPal. We do not accept cash. A 3.5%–5% fee (see Fees Table below) will be added to the reservation for all credit card and PayPal transfers. For wired bank transfers, you are responsible for all bank charges.

  3. Guest Cancellations

    Our fees for cancellations made by you, the guest, for whatever reason, are as follows:

    Note that in some circumstances, our suppliers’ cancellation requirements may be more severe than our own. If this is the case, we will inform you within the actual tour documentation, which as noted above will supersede or be additional to the terms and conditions herein.

    If you are forced to cancel for reasonable reasons beyond your control, you have two avenues of recourse: i) to transfer your tour to another Japan Travel-offered tour in accordance with these terms and conditions, or, ii) to accept a refund, if applicable, and the above cancellation fees and to seek compensation for any losses from your insurance provider. For this reason, we strongly urge guests to buy travel insurance, either from us or from a third-party provider.

  4. Transferring In-house Tour Credits

    Japan Travel will allow you to transfer a tour payment from one tour to another, without penalty, by contacting our Help Desk and providing the credit transfer occurs no later than 30 days before the departure date of the tour you have booked. No credit transfer is allowed in the final 29 days and the normal cancellation rates will apply. Such credit transfer is a one-time offer and is only valid within three months of the original departure date. Once a credit transfer has been applied and if a further cancellation is required, your tour cancellation fees will be:

  5. Excessive Itinerary Changes By Guest

    In building a custom tour, or in providing special requests such as dietary, medical, or child-care needs, we allow up to five changes to your travel itinerary and bookings, free of charge. Change requests in excess of five changes will attract an additional charge per change (see Fees Table below).

  6. Japan Travel Initiated Changes and Cancellations

    To create tours, Japan Travel is a reseller of other vendors’ services, including hotels, bus companies, individual guides and more. The individual components of these tours are therefore delivered on a reasonable best efforts basis and we reserve the right to change at any time and for any reason a listed vendor, activity, place of accommodation, dining option, rental option for example, for an alternative of similar grade and content or function.

    Our tours depend on a minimum number of participants signing up for each tour. Therefore, in the normal course of business, Japan Travel reserves the right to modify tour departure dates, routes, activities, transfers, guide availability and the like. This includes the details of itineraries listed on our website.

    In the event of any Japan Travel initiated changes or cancellations, we will notify you by email as soon as practicable after such changes occur. It is your responsibility to check your emails regularly, to ensure that you are receiving them properly, and to respond within 3 calendar days if you do not agree to the changes, otherwise, you will be deemed to have agreed to such changes.

    Where you do not agree with the changes, and where the parties (yourself and Japan Travel) cannot agree to a compromise, you have two courses of action: i) to transfer your tour credit to another tour conducted by Japan Travel, or, ii) to accept a refund of the monies paid and cancel your tour. You agree to take no legal action whatsoever against us in respect of cancellations, nor to disparage Japan Travel online or otherwise in a public manner.

    In the event of a “Force Majeur”, which may include but is not limited to: acts of God, war (whether declared or undeclared), terrorist activities or threats of terrorists activities, instability in a destination country, incidents of violence, public health issues or quarantine or threats to public health, earthquakes and other natural disasters, nuclear accidents, substantial currency fluctuations, strikes, government restrictions, fire or severe weather conditions, or any other reason that makes it impossible or commercially unreasonable in the sole opinion of Japan Travel to conduct the tour as originally contracted, Japan Travel reserves the right to cancel, modify or delay the tour. If Japan Travel cancels the tour for any such reason, you will receive a full refund of any monies paid, less banking and credit card/PayPal fees.

    Under no circumstances will Japan Travel be responsible for any expenses or financial losses incurred due to changes in itineraries or tour cancellations, including but not limited to airfare penalties, hotel accommodation cancelation costs or loss of income. Therefore, we strongly recommend you buy travel insurance to cover such contingencies and to always re-confirm your tour with us before making any additional travel arrangements and before departure.

  7. Third-party Vendor Liability Limitation

    Japan Travel’s responsibility and liability is strictly limited. We are not responsible for the acts or failures to act, willfully or otherwise, of any third-party over whom we have no control. As a tour operator and travel agent, we promote, organize, and sell tours, which consist of transportation, excursions and accommodation that we purchase or obtain from such suppliers, who are themselves independent contractors unrelated to Japan Travel.

    Insofar as we are a participant in the sale of air transportation, Japan Travel acts as an agent of the air carrier, but is not responsible for the acts or failures to act, willful or otherwise, of any air carrier or their personnel. Any tickets, coupons or receipts issued are subject to the terms and conditions specified by the air carrier.

  8. Tour Description Accuracy

    In preparing our itineraries, we often rely on external sources, such as hotel and activities aggregators, for images and descriptions of amenities and facilities. Whilst we endeavor to ensure that the tour components are accurately described, you agree that such descriptions are made on a reasonable best efforts basis and that we will not be responsible for variations in product/service descriptions to those actually experienced.

  9. Tour Start/End Points

    Please pay attention to your tour documentation and confirm the start and end points. Tour participants are expected to make their own arrangements to reach the tour starting point on the departure date specified. You can either ask your Japan Travel agent to make additional arrangements (at an additional fee) to get you to the tour start point, or make your own way there. To assist those making their own way, after you have made your deposit your Japan Travel agent will in any case provide you with a pre-tour packet that will include information and maps in Japanese and English, including how to get to the tour start point.

  10. Kids and Physically Impaired

    Some of our tours involve physical exertion, risk, or otherwise uncomfortable conditions. We welcome families and physically handicapped people on our tours, but if you have children under the age of 18 or if you or a guest in your care is physically handicapped, then you agree that you and your charges are physically and emotionally able to undertake the tour you are buying. During the tour, if in our sole discretion we assess that the presence of you, your companion(s), or your child/children is impairing the safety, quality of experience, or support capabilities of the other guests or our staff or vendors, then we will ask you to either exit the tour with no refund, or to make an additional payment to provide remedial/assistive care as we in our sole discretion deem necessary. To avoid unpleasant situations, we are happy to work with you and your family to select a service level, activity level, season, date, and destination that will meet your specific needs and capabilities.

  11. Personal Risk and General Disclaimer

    Japan Travel is not liable for any bodily injury or harm, accidents, property damage or personal loss as a result of, but not limited to: physical exertion for which the participant was not prepared; travel by plane, train, car, bus, boat or other mode of transportation (such as bicycle, horse, foot, kayak); consumption of alcoholic beverages; high altitude; forces of nature, such as high winds, hurricanes, flooding; heat exhaustion, equipment failure; civil unrest or terrorism; or the availability of medical services in remote areas and the quality thereof.

    Therefore, as lawful consideration for being permitted to participate in any tour, I hereby RELEASE AND DISCHARGE IN PERPETUITY, JAPAN TRAVEL FROM ANY AND ALL LIABILITY, EXCEPT AS CAUSED BY THE GROSS NEGLIGENCE OF JAPAN TRAVEL, ARISING FROM YOUR PARTICIPATION IN ANY TOUR. I agree that this release shall be legally binding upon me personally, all members of my family and all in my care who are also traveling with my, my heirs, successors, assigns, and legal representatives. It is my intention to fully assume all the risks associated with a tour and to release Japan Travel from any and all liabilities to the maximum extent permitted by law.

  12. Dietary Needs

    Although we specialize in preparing special dietary needs for guests, we cannot control the kitchens and ingredients that our suppliers use. Therefore, you agree to allow us to comply with dietary requests on a reasonable best efforts basis.

  13. Property Damage

    Many of the destinations on your tour will involve your proximity to or use of items such as delicate utensils, ornaments, works of art, electronic devices, rental equipment controls and more. You accept responsibility for any damage to or loss of property of Japan Travel, our suppliers, and any other third parties impacted by your actions. You will be responsible for any compensation for such damage or loss either directly to the third party, or with our assistance (for which we reserve the right to charge an additional fee). In buying a tour from us, you also agree to indemnify Japan Travel from all and any actions or claims (whether or not such actions or claims involve any legal proceedings). In addition you accept full responsibility for all losses, damages, liabilities, payments, costs or expenses (including legal fees and taxes) incurred by yourself or by Japan Travel on your behalf. Please note, you should ensure you have third-party damage included in your insurance coverage.

  14. Travel Documents

    Each guest must obtain a passport, applicable visas, invitation and other immigration documentation for your tour prior to departure. Your passport(s) must be valid for the proposed period of stay. If you are unable to obtain these travel documents, our standard Guest Cancellations policy will apply (see above).   15. Code of Behavior

    As our customer and guest, you agree to the following code of behavior while on any of our tours. If you are managing this booking and are bringing companions, including children or physically impaired guests, you represent the following on their behalf:

    Pre-departure

    • I/we have sufficient abilities, fitness, and medical health to undertake the tour.
    • My/our physical condition or disabilities are not a hazard to either myself/us, other tour guests, or the tour staff.
    • I/we have a valid passport, and where required visas, invitation letters and similar documentation, and exit travel tickets.
    • I/we will read the pre-trip materials about clothing, medical requirements, and culture-specific etiquette.
    • I/we will communicate special requests at least 30 days prior to travel.

    En-route

    • I/we will respect the laws and customs of Japan.
    • I/we will follow environmental and special site guidelines and regulations while on the tour.
    • I/we will follow the instructions of Japan Travel staff, including but not limited to drivers, guides, and third-party vendor representatives.
    • I/we will respect the rights and privacy of other tour members.
    • I/we will respect that sometimes in-tour group decisions will be required, as external factors require Japan Travel staff to improvise. Even though such decisions may be disagreeable to me/us, I/we agree to act in good faith and maintain goodwill and concord with the rest of the tour group.
    • I/we understand that I/we may be refused service or even asked to leave a tour if my/our health or behavior impairs the safety, quality of experience, or support capabilities of the other tour guests or the Japan Travel staff and vendors.
    • I/we understand there will be physical risks involved in some tours and that there may be limited access to medical facilities and evacuation services.
    • I/we will not complain excessively about the weather, the food, or Japanese habits and customs.
    • I/we will always wear safety equipment, such as helmets and life jackets, when requested by Japan Travel staff, and to observe all safety and other rules.
    • I/we will participate in tour activities in a responsible manner, including but not limited to: not wearing headphones when riding, not consuming alcohol during activities, not smoking around others and refraining from making excessive noise.

    Guests not following these simple rules may be asked to leave the tour, and agree that in such instance, there will be no refund for not only the missed tour portion but also any costs of returning home shall be the guest’s own expense.

  16. Travel Insurance

    As a licenced Japanese travel agent, should there be an accident, all our travelers are insured per single incident. Our insurance policy is a group accident insurance policy which is mandated by the Japanese authorities for all domestically registered travel-related companies. Should you wish more comprehensive insurance coverage, we strongly recommend: i) before travelling review your personal insurance and health insurance to see if you have adequate and appropriate coverage to meet your travel needs, and those of any dependants, and, ii) if your existing policy is not sufficient, you should buy additional travel insurance. This can either be from a third party or from us. You must request and purchase insurance from us to receive coverage from us, and this will require special forms and payments to make active. We recommend coverage for loss of property, third party damage (if you are driving or using rental equipment), illness, third-party injury, personal injury, evacuation, and death.

  17. Photograph Rights

    As a customer and guest you grant Japan Travel permission to take photographs or videos of you and your companions and charges during the tour, for future promotional and commercial use, without remuneration. You further agree to assign all right, title and interest you may have in any media in which your name or likeness might appear, to Japan Travel. You agree that we should you provide us with one, we may use your testimonial regarding our services, for promotional and/or commercial purposes without any remuneration. Photographs taken by us are copyrighted to us, and may not be reproduced without permission. That said, if you want digital copies of photos of yourself or your party, for your personal use, we will be pleased to provide them.

  18. Jurisdiction

    It is agreed by and between us and you that all disputes and matters whatsoever arising under or in connection with or incident to the responsibilities of Japan Travel in respect of tours shall be subjected to the laws of Japan and the parties agree to be subject to the exclusive jurisdiction of the courts of Japan.

Japan Travel KK is both a travel agency and an online reseller (“Webshop” or "Japan Travel Webshop") of primarily other vendor’s products and services. Our travel agency (“TA”) Type 2 licence in Japan is 2-7033, and we are bound by the rules and regulations of Japan, which can be found here.

Depending on whether you are a TA customer or a Webshop customer, our agreements with you differ. This agreement covers our Webshop service, and provides our terms and conditions for products and services sold by the Japan Travel Webshop. By purchasing a product or service from the Webshop, you agree to these and the related terms and conditions set out below.

Japan Travel Webshop

We define the Japan Travel Webshop as an online store selling both our own products and services and those of other companies. When a product or service is produced by us, we will label it accordingly, otherwise, the products and services offered will come from other sources. Because there are other sources involved, you must not only read our terms and conditions but also those of the original sourcce, which may have its own specific terms and conditions, and if so, they may supersede or be in addition to the terms and conditions set out herein.   1. Website Usage Rules

    You may only use this website for lawful purposes and you agree to the terms and conditions herein:

    • We may modify or otherwise change the content of the website and you agree to be bound by those changed terms and conditions.
    • You must be more than 13 years old to access this website.
    • If making purchases through this site, you must be more than 18 years old or otherwise have the legal authority in your country to make such purchases.
    • All users making a purchase will become registered members and will receive membership communications on a regular basis, which may be discontinued by changing the settings on your user account.
    • You agree that all information supplied by you will be true and accurate, current and complete.
    • If making purchases through this site, you must be more than 18 years old or otherwise have the legal authority in your country to make such purchases.
    • If you have a membership account with us, it is your responsibility to guard the details and actual access of that account, and you will be solely responsible for access by another party to your account.
    • We retain the right at our sole discretion to remove access to anyone on this website and to discontinue or change the services offered, at any time and for any reason.
  2. Payment Methods

    Payment must be in Japanese Yen, and can be made by credit card (Visa, Master Card, American Express, Diners, or Union Pay), bank-to-bank telegraphic transfer, or PayPal. We do not accept cash. A 3.5%–5% fee (see Payment Surcharges Table below) will be added to the reservation for all credit card and PayPal transfers. For wired bank transfers, the foreign exchange rate will be set by the receiving bank, unless you pay in Japanese Yen. For all bank transfers, you are responsible for all bank charges. Western Union and similar payment methods are not accepted.

  3. Taxes

    Japan Travel charges standard consumption taxes for all purchases from the Webshop, as these purchases are defined in Japanese tax law as being consumed in Japan. Certain of our other products and services also include customary taxes, such as hotels and entertainment tax, and unless shown separately are already included in the product or service.

  4. Prohibited Actions

    You may not use this site for any of the following:

    • Use with the intent to make false, fraudulent, speculative purchases, or any purchase in anticipation of increased demand and therefore resale.
    • Access the site by robotic means, or by using scrapers, whether low-wage humans or software.
    • Subvert any robot blocking files or other measures designed to exclude robots from visiting all or parts of our website.
    • Use any device or software or human activity that is designed to interfere with the normal operation of our website, or to create unreasonable loads on our servers.
    • Reproduce, duplicate, copy, sell, trade, resell, or otherwise commercially exploit the contents of our website, without seeking our written permission (and commercial terms) first.
    • Frame or otherwise reproduce parts of our site on another site.
    • Modify or attempt to modify, reverse engineer, the website or software code therein.
    • Use our site or features therein in such a way that is unlawful, harmful, objectionable, or otherwise inappropriate, as determined solely by us.
    • Post on or distribute from our website any material that violates the rights of third parties.
    • Harvest names and contact information about individuals on our site.

  5. User Contributions

    As Japan Travel is a community site, you are likely to be leaving publicly viewable messages, comments, photos, articles, and other content (this section excludes credit card information and undisclosed personal details) on our site. You agree that in leaving such content:

    • You are granting Japan Travel and its affiliates a perpetual, transferrable, irrevocable, non-exclusive, and royalty-free right to use, translate, edit, and reproduce that content for promotional and commercial benefit, or as Japan Travel may otherwise deem fit.
    • If we wish to identify you as being the contributor of the content, the user name you have registered with the website may be used.
    • You will not infringe any patent, trademark, copyright, or otherwise protected information, by publishing it on our site.
    • You may not post any content which is unlawful, libelous, defamatory, obscene, harassing, threatening, invades privacy, abusive, fraudulent, or otherwise objectionable.
    • You may not impersonate another person or otherwise misrepresent yourself.
    • You may not upload viruses, corrupted data, or other harmful content.
    • May be modified or deleted if in our sole opinion the content is of a commercial or promotional nature.
    • Japan Travel takes and has no responsibility for data uploaded by you from being lost, corrupted, deleted, or otherwise damaged.
    • Japan Travel takes no responsibility for errors and language that have been posted by you, or which may be inadvertently introduced through our system functions.
  6. Privacy Policy
    • Japan Travel is concerned about the integrity and confidentiality of your personal information, and unless otherwise stated will never share specific personal information with a third party, unless required to by law.
    • Suppliers Exception. Of course, where you are buying a product or service through us and we need to supply your personal information onward to the intended supplier, you give us permission to provide that information. We make every effort to use ethical and responsible suppliers, nonetheless, you agree that we are not responsible for the actions of those suppliers.
    • We are not responsible for unauthorized access of your account by someone using your password and login information, with or without your permission, unless it is specifically due to a technical failure in our systems.
  7. Webshop Not Agency

    The Japan Travel Webstore is NOT a travel agent. If you require a licensed travel agent’s services, please go to our Travel Agency subsite. The Japan Travel Webstore is effectively a travel search engine that accesses travel services and products created or resold by other companies and individuals. Accordingly, the display of such products and services on our website does not mean that we endorse, recommend, sponsor, or approve of any item on the Webstore, nor, except where specifically noted are we affiliated in any way. Since our products and services displayed come from external suppliers, such as hotel and activities aggregators, you agree that such descriptions are made on a reasonable best efforts basis and that we will not be responsible for variations in product/service descriptions to those actually experienced.

  8. Limitation of Liability

    DUE TO THE UNPREDICTABLE NATURE OF THE TRAVEL BUSINESS YOU ACKNOWLEDGE AND AGREE THAT THE CONSIDERATION WHICH JAPAN TRAVEL IS CHARGING HEREIN MEANS THAT JAPAN TRAVEL SHALL NOT BE RESPONSIBLE TO YOU FOR ANY LOSS-OF-PROFIT, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; EXPENSES, OR LOSSES INCURRED DUE TO CHANGES IN ITINERARIES AND TRAVEL CANCELLATIONS); LEGAL CHALLENGE UNDER THE TOURISM OR OTHER LAWS, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

    WITHOUT LIMITING THE GENERALITY OF THE PROVISIONS OF THIS SECTION AND EXCEPT TO THE EXTENT PROVIDED FOR HEREIN, THE MAXIMUM AGGREGATE LIABILITY OF JAPAN TRAVEL TO YOU OR TO ANY PERSON, ENTITY, FIRM OR CORPORATION WHATSOEVER ARISING OUT OF OR IN THE CONNECTION WITH ANY SERVICE DELIVERED HEREUNDER, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED ON BREACH OR REPUDIATION OF CONTRACT, WARRANTY, TORT OR OTHERWISE, SHALL IN NO CASE EXCEED ONE HUNDRED (100%) PERCENT OF THE PROFIT MARGIN RECEIVED FROM THE RELEVANT TRAVEL PRODUCT OR SERVICE SOLD. THE ESSENTIAL PURPOSE OF THIS SECTION IS TO LIMIT THE POTENTIAL LIABILITY OF JAPAN TRAVEL ARISING OUT OF THIS AGREEMENT. THE PARTIES ACKNOWLEDGE THAT THE LIMITATIONS SET FORTH IN THIS SECTION ARE INTEGRAL TO THE AMOUNT OF CONSIDERATION LEVIED IN CONNECTION WITH THE PRODUCT SUPPLIED OR SERVICE BEING RENDERED AND THAT TO ASSUME ANY FURTHER LIABILITY OTHER THAN AS SET FORTH HEREIN WOULD REQUIRE SUCH CONSIDERATION TO BE SET SUBSTANTIALLY HIGHER.

  9. Personal Risk and General Disclaimer

    Japan Travel is not liable for any bodily injury or harm, accidents, property damage or personal loss as a result of, but not limited to: physical exertion for which the participant was not prepared; travel by plane, train, car, bus, boat or other mode of transportation (such as bicycle, horse, foot, kayak); consumption of alcoholic beverages; high altitude; forces of nature, such as high winds, hurricanes, flooding; heat exhaustion, equipment failure; civil unrest or terrorism; or the availability of medical services in remote areas and the quality thereof.

    Therefore, as lawful consideration for being permitted to participate in any tour or other product or service offered on the Japan Travel Webshop, I hereby RELEASE AND DISCHARGE IN PERPETUITY, JAPAN TRAVEL FROM ANY AND ALL LIABILITY, EXCEPT AS CAUSED BY THE GROSS NEGLIGENCE OF JAPAN TRAVEL, ARISING FROM MY PARTICIPATION IN ANY TOUR OR OTHER PRODUCT OR SERVICE. I agree that this release shall be legally binding upon me personally, all members of my family and all in my care who are also traveling with me, my heirs, successors, assigns, and legal representatives. It is my intention to fully assume all the risks associated with my trip to Japan and to release Japan Travel from any and all liabilities to the maximum extent permitted by law.

  10. Dietary and Special Needs Customers

    If you are buying food-related or mobility services from our Webshop, please be aware that Japanese suppliers have a low awareness of special dietary and special physical needs. If you subsequently consume one of the products or services sold on our site and have an allergic reaction or physical distress, we will NOT take responsibility for that outcome. We suggest that if you have special dietary or other special needs, that you consider purchasing a custom tour from our Travel Agency team.

  11. Travel Documentation

    Each customer will be expected to have a valid passport, applicable visas, invitation and other immigration documentation arranged prior to purchase of products and services from our Webshop. Failure to obtain these documents shall NOT serve as an excuse for refund claims following purchase.   12. Travel Insurance

    Products and services purchased of our Webshop, unless otherwise stated, do NOT include travel insurance. Therefore, is you wish to obtain travel insurance you will need to either buy it from us or a third party. You may do so by either selecting one of the travel insurance options on the site, or by contacting us. We recommend a minimum coverage of loss of property, third party damage (if you are driving or using rental equipment), illness, third-party injury, personal injury, evacuation, and death.

  13. Jurisdiction

    It is agreed by and between us and you that all disputes and matters whatsoever arising under or in connection with or incidental to the responsibilities of Japan Travel in respect of tours shall be subjected to the laws of Japan and the parties agree to be subject to the exclusive jurisdiction of the courts of Japan.

Terms & Conditions

  1. Service
    1. The JapanTravel.com FreeSIM Bundle is a freemium data-only mobile service secured by a fully refundable deposit prepaid by the customer, (hereinafter the “Service").
    2. Japan Travel KK reserves the right to change the terms and conditions and nature of the Service without prior notification. Such service changes may be on the initiative of our company alone, or may be implemented in response to changes by our upstream MVNE, Sorcom.io, or our carrier, NTT DOCOMO.
    3. Service is only available in Japan and corresponds to the service area provided by NTT DOCOMO.
  2. Service availability
    1. An agreement for the use of the Service (hereinafter referred to as "Service Agreement") is deemed to be approved and executed by both parties when the User completes their Registration process online or through the Admin App.
    2. The Service Agreement continues until the Service terminates after 100MB or seven days, or for subsequent periods of same duration if there has been a Top Up of the user’s account by the payment of fees for such Top Up, until expiration of said Top Up(s). Top Ups may continue indefinitely.
  3. No transfer of rights, etc.
    1. Users can not transfer the right to use the Service under the Service Agreement and the SIM Card.
    2. Users cannot provide or resell use of the Service to third parties.
  4. Deposits
    1. In due consideration of the Service being free for the first tranche of data for the first seven days, User agrees to place a refundable deposit with Japan Travel KK for the duration of the service. Deposit shall be made by PayPal, Credit Card, or other means providing by Japan Travel KK from time to time.
    2. Deposits will be refunded in full, so long as User returns the SIM within 48 hours of the last day of Service, the end of which day is 23:59. The SIM must also be in good working order and free of physical damage. Japan Travel shall exclusively determine whether a SIM return is acceptable.
    3. All deposits returned will be returned in the same means as they were received, meaning, if by Credit Card, then the return will be by the same Credit Card.
  5. ID and password
    1. Users are responsible for keeping their telephone number, access code information (hereinafter "ID"), credit card information, and other personal details safe. None of this information should be provided for use by third parties.
    2. Japan Travel KK has the right to ask Users to show ID as part of the execution of this Service Agreement.
    3. Japan Travel KK is not liable for damages sustained by Users or damages caused by Users in connection to their use of the Service.
  6. Privacy
    1. In normal services, Japan Travel KK will protect your data and never resells or repurposes data to external parties that can be attributed to a single individual. This means no other party will have your name, house address, or contact details.
    2. For services run as a promotion with another company, where your data may be shared between ourselves and the partner (such as a sweepstakes or other contest), we will always inform you upfront about who will receive the data and how it will be used, and give you the right to opt out.
    3. To make our SIMs free to use, we do aggregate data from users and resell this to 3rd parties such as retail chains and consumer products companies. Known as "Big Data", this information is not granular enough to identify you as a person.
    4. We also use your location to help us serve ads and other promotions.
  7. Conditions of service use
    1. Users can not use the Service through an IP address other than that specified by Japan Travel KK.
    2. Users may not disassemble, damage, or reverse-engineer the SIM Card, its embedded software, or the Admin App.
    3. Users may not transport the SIM card out of Japan without the permission of Japan Travel KK.
    4. Users agree to exercise due care in the handling of the SIM card, including its safe return.
    5. Users must return the SIM card to Japan Travel KK within 48 hours of the 7th day of use. The end of this day is 23:59 on that day.
    6. No replacement will be provided in case the SIM Card is lost, destroyed, or damaged. Instead, Users will be required to apply for a new SIM, and the deposit on the lost/destroyed/damaged SIM will be forfeited.
    7. User agrees that it will only use the SIM in a data communication device bearing a Technical Standard Conformity Certification Mark as required by Japanese Telecommunications Law
  8. Misuse of the device
    1. User may not use the SIM to engage in the sending of spam email or threatening or otherwise illegal communications. Discovery of such activity may lead to immediate suspension of service.
    2. Users found browsing or handling Child Pornography via this product may also be reported to the police.
  9. Service suspension
    1. Japan Travel retains the right to suspend the Service at any time and for any reason, including: invalidation of security deposit, hitting the data or period limits, misuse of the device, and upstream telecommunications maintenance, faults, or other unavoidable events.
    2. In such cases, Japan Travel KK will make best efforts to give prior notice of suspension, so that Users have time to respond and remedy the situation.
  10. Limited warranty and liability
    1. Japan Travel KK offers no warranty in connection with the Service for such parameters as: connectivity, speed, and such quality of service issues.
    2. Japan Travel KK accepts no liability for damages, irrespective of the cause, sustained by Users in connection with the use of the Service.
    3. In the event that liability is proven in a court of law, then the maximum financial liability incurred by Japan Travel KK shall not exceed the amount the User paid as deposit for the Service.
  11. Language
    1. The English version of this agreement constitutes the official agreement between Japan Travel KK and the User.
    2. Versions written in languages other than English are for convenience only and shall have not legal force.
  12. Governing law
    1. This agreement shall be governed exclusively by the laws and courts of Japan. In the event of a dispute, hearings shall occur at the Tokyo District Court.
